Title: Nexuus Terms of Service

Welcome to Nexuus. By accessing, downloading, or using our app, services, or website (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). These Terms form a legally binding agreement between you and Nexuus Management LLP ("Nexuus," "we," "us," or "our") under Indian law and applicable international laws. If you do not agree with any part of these Terms, you must immediately cease using the Platform.

1. Eligibility & Jurisdiction

  • You must be at least 18 years old and legally competent under the Indian Contract Act, 1872.
  • Access to Nexuus is prohibited where restricted by law.
  • These Terms are governed by Indian law and applicable international treaties and conventions.

2. User Responsibilities

  • Provide accurate, current, and complete information.
  • Do not impersonate others or create false identities.
  • No harassment, defamation, obscene, offensive, or illegal behavior.
  • No fraudulent or unauthorized use of the Platform.
  • Respect intellectual property and privacy rights.

3. Account Security

  • You are solely responsible for maintaining the confidentiality of your credentials.
  • You must report any unauthorized access immediately.

4. Subscription, Payments, and Refunds

  • All purchases are final. Refunds will be issued only if required by applicable consumer law.
  • Features are engagement-gated; no guarantee of fixed delivery schedules.
  • We reserve the right to modify pricing and plans with notice.

5. User Content

  • You grant Nexuus an irrevocable, royalty-free, worldwide license to use, analyze, distribute, and modify your content for operational and promotional use.
  • You must not upload misleading or copyrighted content without permission.

6. AI Matchmaking & Data Use

  • AI tools are experimental and not guaranteed to yield results.
  • Voice and behavioral data may be stored and analyzed to improve services.
  • You consent to recording, analysis, and AI training usage.

7. Third-Party Promotions

  • Nexuus is not liable for any third-party offers or promotions.

8. Prohibited Conduct

  • No scraping, reverse engineering, bots, or coordinated manipulation.
  • No competitor benchmarking, surveillance, or data extraction.
  • Strict action and legal prosecution for any abuse or exploit.

9. Termination of Service

  • Nexuus reserves the right to suspend or terminate accounts at our sole discretion.
  • No refunds are due upon termination.

10. Disclaimer of Warranties

  • The Platform is provided "as-is." No warranties are given regarding outcomes, availability, or user compatibility.

11. Limitation of Liability

  • Total liability is limited to the amount paid in the last 6 months.
  • We are not liable for indirect, incidental, special, or consequential damages.

12. Dispute Resolution

  • Mandatory mediation precedes litigation.
  • Jurisdiction: Courts of India.
  • No class actions or representative suits are permitted.

13. Privacy & Data Collection

  • See our Privacy Policy. You consent to biometric data capture, voice transcription, and algorithmic personalization.

14. Monitoring & AI Moderation

  • Automated and human moderation may intervene at our discretion.

15. No Waiver

  • Any failure to enforce rights does not constitute waiver.

16. Intellectual Property

  • Nexuus owns all IP including AI systems, UI, voice tech, and algorithms. Unauthorized reuse is prohibited.

17. Anti-Fraud Measures

  • Immediate bans for fraud, identity manipulation, or abuse.
  • We will report violators to relevant cybercrime and legal authorities.

18. Competitor Restrictions

  • Competitors and their affiliates are strictly prohibited from using Nexuus.
  • Legal action will be pursued for cloning, data scraping, or sabotage.

19. Platform Evolution

  • We may release experimental features; participation is considered consent.

20. Modifications

  • Terms may be updated. Continued use signifies acceptance.

21. Export Controls & Sanctions Compliance

  • You agree to comply with all Indian and international export laws.
  • You confirm that you are not a prohibited party under any applicable trade regulation.

22. Severability

  • If any part of these Terms is found unenforceable, the remaining sections remain valid.

23. Force Majeure

  • Nexuus is not liable for failure to perform due to unforeseen events beyond our control.

24. Governing Language

  • These Terms shall be interpreted in English. Translations are for reference only.
